Welcome to Hold This Inc. (in Canada) and Hold This Please Inc. (in the United States). Please read these Terms and Conditions ("Terms") carefully, as they govern your use of our website, mobile applications, and related services (collectively, the "Services").​ By using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.


1. Definitions

    Customer: A user who sends or receives packages via a Holder.

    Holder: A user who receives and stores packages on behalf of Customers.

    We/Us: Hold This Inc. (Canada) or Hold This Please Inc. (U.S.), depending on your location.

2. Eligibility

You must be at least 18 years old to use our Services. By creating an account, you confirm that you meet this age requirement and are legally able to enter into these Terms.


3. Changes to Terms

We may revise these Terms from time to time. Continued use after changes constitutes acceptance. The current version will always be accessible via our website or app.


4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You must immediately notify us of any unauthorized use or breach of security.


5. Acceptable Use

You agree not to:

    Use the Services for illegal activities, including sending or storing prohibited, stolen, or dangerous items.

    Misrepresent your identity or the contents of a package.

    Attempt to reverse engineer, bypass, or misuse any part of the platform.

    Harass or impersonate other users.

6. Package Handling Disclaimer

Hold This provides a platform to facilitate package receipt and storage. We do not open, verify, or guarantee the contents of any package. We are not a courier or shipping service.

Responsibility for:

    Lawfulness and safety of the package contents,

    Accuracy of shipping and contact details,

    Timely pickup and handoff,

lies solely with the Customer and the Holder.

We are not liable for loss, theft, or damage unless directly caused by gross negligence or misconduct on our part

7. Service Availability

We strive to maintain uptime and functionality but do not guarantee uninterrupted access. We may limit, suspend, or terminate the Services at any time.


8. Payments and Stripe Integration

All payments are processed through third-party provider Stripe. By using the Services, you agree to be bound by Stripe’s Terms of Service. We are not responsible for issues arising from third-party services.


9. Intellectual Property

All content and software related to the Services are owned by Hold This or its licensors. You may not reproduce, distribute, or modify any part without explicit written permission.


10. Disclaimers

The Services are provided "as is" and "as available". We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.


11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages. In jurisdictions where such limitations are not allowed, our liability is limited to the greater of CAD $100 or the amount you paid us in the last 6 months.


12. Indemnification

You agree to indemnify and hold harmless Hold This Inc. / Hold This Please Inc., their officers, agents, employees, and partners, from any claims or liabilities arising out of your use of the Services or breach of these Terms.


13. Dispute Resolution

You agree to attempt to resolve any dispute through informal negotiation first. If unresolved:

    For Canadian users: Disputes will be subject to binding arbitration in Calgary, Alberta, governed by Alberta law, unless otherwise required by local consumer laws.

    For U.S. users: Disputes will be resolved by binding arbitration in Delaware, under Delaware law, unless otherwise required by applicable state law.

This clause does not restrict statutory rights available under local consumer protection legislation.


14. Governing Law

These Terms shall be governed and interpreted in accordance with:

    The laws of the Province of Alberta and the federal laws of Canada applicable therein, if you are using the Services in Canada, or

    The laws of the State of Delaware and the United States, if you are using the Services in the United States.

Local consumer protection laws in your province, territory, or state of residence may also apply to your use of the Services and override certain provisions of these Terms to the extent required by law.


15. Termination

We reserve the right to suspend or terminate access to the Services, with or without notice, if we believe you have violated these Terms or pose a security risk.
